I would try flashing the latest firmware before contacting whomever you bought it from about returning it.

If you’ve flashed the latest firmware (there is a guide and links to videos) and that’s what you’re seeing OR you can’t flash the latest firmware because the watch doesn’t seem to “connect” to a Windows PC where you are running SP Tools, my next step would be to remove the back and pull the battery connection. It also wouldn’t hurt to check the terminals on the watch dock to be sure they are working correctly both for charging and USB connection.
